Please read this disclaimer carefully. By using the Paradise Pickup app and entering the Paradise Play Park Arena, you acknowledge and agree to the following terms.
1. Professional Security & Safe Space
We are committed to providing a safe, inclusive environment for all participants.
- Security Presence: We provide professional security services at the arena to monitor the premises and maintain order.
- No Absolute Guarantee: While our security team is there to deter misconduct and assist in emergencies, the presence of security does not constitute a guarantee of absolute safety or a “protection contract” for individual participants.
- Mandatory Cooperation: All users must follow the instructions of on-site security personnel at all times. Failure to do so will result in immediate removal and a permanent ban from the app and the arena.
2. User Assumption of Risk
- Physical Activity: Sports involve inherent risks of injury (e.g., sprains, fractures, or cardiac events). By joining a game, you represent that you are physically fit to play.
- The Venue: You acknowledge that you are using a physical sports facility. You assume all risks associated with the playing surface, lighting, and weather conditions.
- Interactions: Paradise Pickup facilitates the connection between hosts and players. You assume the risk of interacting with others in a competitive physical environment.
3. Limitation of Liability
To the maximum extent permitted under the laws of Trinidad and Tobago:
- General Liability: Paradise Pickup and Paradise Play Park Arena (including owners, employees, and security contractors) shall not be liable for any personal injury, death, or property damage occurring on the premises.
- Personal Property: We are not responsible for the loss, theft, or damage of personal belongings (e.g., phones, bags, jewelry, or vehicles) even while security is present.
- Conduct of Others: We are not liable for the intentional or unintentional actions of other players or spectators.
4. Cancellations & Venue Maintenance
- Venue Rights: We reserve the right to cancel any scheduled game if the physical space becomes unsafe (e.g., maintenance issues or extreme weather).
- Refunds: In the event of a venue-led cancellation, a full refund of the game fee will be issued via the app, excluding non-refundable platform service fees.
5. Dispute Resolution & Conduct
- Zero Tolerance: Any violence, verbal abuse, or harassment—despite the presence of security—will be handled by our security team and may be reported to the Trinidad and Tobago Police Service (TTPS).
- App Mediation: Paradise Pickup does not mediate personal disputes between users. Our role is limited to enforcing the App’s Terms of Service and Venue Rules.
6. Modifications
We may update this Disclaimer to reflect changes in security protocols or venue operations. Continued use of the App or Venue indicates acceptance of these updates.
